These Terms of Service govern your use of rowanandhearth.com and purchases from Rowan & Hearth. Rowan & Hearth is operated by EKSC LTD, company number 15834846, with its registered office at 4th Floor, 205 Regent Street, London, England, W1B 4HB, United Kingdom.

By accessing the website or placing an order, you agree to these Terms, our Privacy Policy, Returns and Refund Policy, and Shipping and Delivery Policy. Nothing in these Terms limits mandatory rights that cannot lawfully be excluded.

1. Eligibility and information supplied

You must have legal capacity to enter into a purchase contract. You agree to provide current, complete and accurate contact, delivery and payment information and to use only payment methods you are authorised to use.

2. Products and presentation

We take reasonable care to describe and display products accurately. Colours, scale and appearance may vary because of lighting, screens, handmade characteristics and manufacturing tolerances. Product measurements are approximate unless expressly stated otherwise.

We may update descriptions, prices, availability and product ranges without notice. This does not affect an order already accepted, except where an obvious error or legal requirement must be addressed.

3. Orders and contract formation

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean the order has been accepted. We may refuse or cancel an order before fulfilment for reasons including stock unavailability, pricing or description errors, failed payment, suspected fraud, sanctions or delivery restrictions.

A purchase contract is formed when we confirm acceptance or begin fulfilment, depending on the circumstances and applicable law.

4. Prices, currencies and payment

Prices are shown in the currency selected for the relevant market. Taxes, shipping costs and other charges are displayed at checkout where applicable. Currency conversion and rounding may cause small differences between markets.

Payment is processed through authorised third-party providers. We do not normally store full payment-card details.

5. Promotions and discounts

Promotions apply only to eligible products, quantities, markets and dates stated in the offer. Automatic discounts are calculated in the basket or at checkout.

• For regular multi-buy products, qualifying quantities may receive 20%, 25% or 30% off as displayed.
• For eligible Buy 2, Get 1 Free products, the lowest-priced eligible item is normally discounted, and the offer may repeat up to the stated limit.
• Unless expressly stated, promotions cannot be combined with other product or order discounts.
• Free standard delivery does not make express or premium shipping free.

We may correct, suspend or withdraw a promotion where there is an obvious error, abuse, technical failure or legal requirement. This does not affect mandatory rights relating to an order already accepted.

6. Delivery

Delivery options, prices and estimates are described in our Shipping and Delivery Policy and at checkout. Estimates are not guaranteed dates. Risk in goods passes as required by the law applicable to the purchase.

7. Returns, refunds and cancellations

Returns, refunds, cancellations and promotional-order adjustments are governed by our Returns and Refund Policy and any mandatory consumer rights that apply to you.

8. Website use

You may use the website only for lawful personal or business purchasing purposes. You must not:

• Interfere with security, operation or access controls.
• Introduce malicious code, scrape the website in an abusive manner or attempt unauthorised access.
• Use false information, impersonate another person or engage in fraud.
• Copy, republish or exploit protected content without permission.
• Use the website in a way that violates applicable law or the rights of others.

9. Intellectual property

The website, branding, layout, text, graphics, photographs and other content are owned by or licensed to EKSC LTD and are protected by applicable intellectual-property laws. Limited personal use does not transfer ownership or grant a commercial licence.

10. Reviews and submitted content

Where you submit a review, photograph, suggestion or other content, you confirm that you have the right to do so and that it is lawful and accurate. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating and promoting the business, subject to applicable privacy law.

11. Third-party services and links

Our store uses third-party services including Shopify, payment providers and carriers. Third-party websites and services may have separate terms and policies. We are not responsible for third-party content or services outside our reasonable control.

12. Disclaimer and liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud or mandatory consumer protections. Subject to those protections, we are not liable for indirect or unforeseeable losses, loss of profit, or events outside our reasonable control.

Our total liability relating to a purchase will not exceed the amount paid for the affected order, except where a higher liability is required by law.

13. Indemnity

To the extent permitted by law, you agree to compensate us for losses arising from your unlawful use of the website or material breach of these Terms.

14. Severability and waiver

If part of these Terms is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.

15. Governing law

These Terms are governed by the laws of England and Wales. However, if you are a consumer, you retain any mandatory protections provided by the law of the country where you habitually reside, and this clause does not prevent you from using any court or dispute process available to you under mandatory law.

16. Changes

We may update these Terms from time to time. The version published when an order is placed normally applies to that order, except where a change is required by law.
